Business License Division

The Business License Division administers the Business License Ordinance. Every person or entity engaged or intending to engage in business is required to obtain a license based on business activity and gross receipts. Business license fees are due prior to commencing operations, and annually on April 30th beginning with the 2022/2023 Business License year. 

Construction-Related Contractors

Construction Contractors are not eligible for Annual Business Licenses with the Town of Meggett.

Construction Contractors Licenses are issued on a pay-per-job basis. This helps us ensure that proper permits are obtained for projects and saves contractors (that may only work in Meggett every few years) the hassle of renewing a license annually. Although ordinary business licenses are issued for a 12-month period beginning May 1 and ending April 30, business licenses for construction contracts issued on a per-project basis expire at the completion of the construction project. SC Code Sec. 6-1-400(B)(1).

Business Licenses Explained

Chapter 8, Businesses & Business Regulations, of the Town of Meggett Municipal Code, as authorized by SC Code Sec. 5-7-30, provides for the assessment of a business license tax against the gross income of business operations. This tax is an excise tax. The Town of Meggett assesses the tax based on the business classification according to the North American Industry Classification System (NAICS). Taxes are applied to all businesses operating in the Town, including those businesses whose operations are based outside the Town limits.

Additional Requirements

Additional requirements include:
  • All businesses or trades must have copies of any required South Carolina licenses, registrations and/or inspections for your type of business.
  • All restaurants and prepared food related businesses required Health Department approval. 
  • Retail sales businesses are required to obtain a South Carolina sales tax ID number.
  • If alcohol, beer, or wine is to be served, State law requires a DOR permit, a copy of which must be presented with the license application.

Federal & State Regulations

Federal Regulations
​There are several federal and state requirements to meet if you plan to hire employees. You file a form SS-4 with the Internal Revenue Service (IRS) and the IRS will assign an Employer Identification Number (EIN) to your business. You will then be liable for federal withholding taxes and FICA. The toll-free number to order the SS-4 is (800) 829-FORM (3676).​
State Regulations
Retail Licenses are required by some businesses and are issued by the South Carolina Department of Revenue. There is a branch office in Charleston and they may be contacted at (844) 898-8542 for information on these and other State required licenses and permits.

Restaurants, grocery stores, and other businesses that handle food must be approved by the South Carolina Department of Health & Environmental Control (SCDHEC) prior to operation. If any alcohol is served, an Alcohol Beverage License (ABL) is required by law. Many other professions and contractors must also be licensed by the South Carolina Department of Labor, Licensing and Regulation (LLR).

To work in the Town of Meggett, contractors must obtain a State Contractor's or Home Builder's license prior to approval for a Town Business License. You may contact the State Contractors Board at (803) 896-4834 for Residential Contractors, or (803) 896-4686 for Commercial Contractors, for more information.
